Death of James Brady, Reagan press secretary, ruled a homicide

A medical examiner has ruled the recent death of former White House press secretary James Brady, who was wounded in the 1981 assassination attempt on President Ronald Reagan, a homicide, raising the possibility John Hinckley Jr. could be charged with murder.

Members of the Metropolitan Police Department’s Homicide Branch, the United States Attorney’s Office, and the Federal Bureau of Investigation are reviewing the case, according to a police press release issued Friday.

I’m fine with the murder charge for a decades-old act, too, if you can tie the injury to the cause of death. What I’m confused about is how they expect to convict when he was already found not guilty by reason of insanity. Would that decision not stand, and would this not be retrying him for the same act, with merely a higher charge?

IIRC, a victim must die within a year and a day in order for the death to be ruled a murder.

That was the rule at common law, but many states have changed it by statute.

Just because someone is judged insane doesn’t mean a homicide didn’t take place. I don’t the facts of what the ME found. Since Hinckly was found insane I doubt there will be a retrial.

After 30 years I sincerely doubt that I would vote,as a juror,to convict Hinkley of murder in any of its degrees.Attempted murder,sure,but no physician,no group of physicians,could convince me beyond a reasonable doubt of *murder*.

I guess we don't really know if they expect to bring charges.

Even if they can't bring charges, though, if he died as a result of the shooting, it should say "homicide" on his death certificate.

The truth is the truth, no matter what.

Maybe Mr. Brady's children could sue the shooter? My understanding is that the shooter's family has (or had) quite a bit of money.

I was a kid when President Reagan was shot. One of the most upsetting, saddest days of my life. I know precisely where I was when I heard it and remember feeling shocked out of my skin. I have less than no sympathy for the shooter, whose name I choose to not even write.

He tried to kill an elected president. There are few acts more un-American than what he did. He should not be out going to movies and spending weekends on vacation.

The shooting was in DC, so federal law would apply. Unless there was a specific statue changing the rule, the common law rule would still apply. Regardless, I don't think that there is a 21 years and a day rule in any state.

FWIW, California changed it to 3 years and a day.

Nothing personal, but that attitude is un-American!

The POTUS should not be any more important than the guy who works the midnight shift @ 7-11. We used to understand that in America. I was always proud that Hinckley got a fair trial, even if I didn't like the outcome.

Nowadays, they shoot trespassers on sight near our rulers.

I’m all for keeping Hinckley locked up. But this has the stink of James’ skiffy wife. She can’t quit politicking even when her husband has been dead for a day. She’s every bit the pig that Billary is.

As I recall, Dan Rather reported Brady died on the day of the shooting.
