Don't forget what Perry said in his statement as to what he was trying to accomplish.
It wasn't stopping border crossings, arresting illegals, etc. Here's an excerpt
from his announcement. Note the bolding.

preparations for the deployment of up to 1,000 National Guard troops to the border.
These troops will support the Texas Department of Public Safety's (DPS) ongoing law

activity
in the region resulting from the federal government's failure to adequately
secure the border.

People here really need to catch a clue.

Our very own Supreme Court has ruled that states cannot use National Guard troops to enforce immigration.

Perry does have the authority to use the Texas NG for the purpose laid out in his release and it will be difficult for Obama to stop him.

Once the NG is deployed and focusing the media on what is really going on there, well - things can change.

Perry has a well thought out plan to thread the needle of legality and separation of powers here. That's why he had his AG do the brief
