Colorado Cake Company Appeals Decision Forcing Them to Make Cakes for Same-Sex Weddings

A Colorado baker who was found guilty of discrimination for not baking a wedding cake for a same-sex couple is appealing the decision.

Jake Phillips of Masterpiece Cakeshop hopes to win at the appellate level after being told that he must serve gay couples wedding cakes and take a diversity course.

Phillips is being represented by the Alliance Defending Freedom, who filed the appeal in the Colorado Court of Appeals last Wednesday.

ADF lead counsel Nicolle Martin, who is involved in the appeal, said in a statement that Phillips did not unlawfully discriminate against anyone, but rather refused to endorse something he morally disagreed with.

"This is not about the people who asked for a cake; it's about the message the cake communicates," said Martin.

"Just as Jack doesn't create baked works of art for other events with which he disagrees, he doesn't create cake art for same-sex ceremonies regardless of who walks in the door to place the order."

In 2012, Charlie Craig and David Mullins wanted Phillips to make a cake for their wedding reception.

Phillips explained to the couple that he could make them other baked items but, because of his Christian beliefs, he will not make them a cake for their reception.

With the aid of the American Civil Liberties Union of Colorado, Craig and Mullins filed a complaint with the Colorado Civil Rights Division.

The division determined that Masterpiece Cakeshop had discriminated against them. According to the ACLU, the division's findings led the state attorney general's office to file a formal complaint against the company via the state courts.

I will respond to your “hypothetical”, but what “kind of freedom” are you talking about? All American Citizens are guaranteed their God Given Rights under the Constitution, as they were before any Civil Rights Legislation was passed.

To your question, if White People are as Racist as Obama and Holder say they are, probably not. Since I don’t buy this Racist stuff, I really can’t agree with your Premise.

If you believe Civil Rights Legislation can force Private Citizens to provide services to any other person without exception, you should have no problem with a Baker being forced by threat of Financial Ruin or even imprisonment to use his skills to Bake a Cake for some perpetually offended Libtard.

Now, if you have a Government Agency treating certain Citizens differently than any others, that’s a different story. That kind of act is nothing but naked Tyranny.

Why isn’t a violation of the Civil Rights Act when people are attacked and singled out by the IRS, or any other Alphabet Agency cowtowing to the Liberal Regime in power?

Legislation should limit Government, not the Freedoms of the Governed. As I stated in my original Post, the Civil Rights Act violated the Constitutional Rights of all Citizens, no matter their Race, Creed or Color to freely Associate. I guess we should add Religious and Political Beliefs just to cover all the bases.

Forced Tolerance is intolerable in a Free Society.

What if a post hs indications that the one posting is oxygen deprived or even a closet dem?

Or perhaps, what IF, we as a people remember that we are FREE. And we have tbe inherent freedom to associate, work for, provide services for ANYONE we choose. Or not.

1. There is no Constitutional right to force someone to provide a particular service.

For now. The liberals are working on that - one of the biggest dangers to Obamacare, long term, is the number of doctors who are refusing to go along with it. They'll need to invent some "penumbras and emanations" that will allow the government to essentially conscript doctors into servitude.

As for the bakery case. I'd think the Hobby Lobby ruling regarding the application of RFRA should help out. There's no way that forcing this guy to make a wedding cake and to go to a re-eductaion camp is the least infringing way the government can achieve it's objectives.

What if a White man refuses to bake a cake for a black man because he is marrying a white woman?

Then the couple should find another baker and let everyone know the baker is a bigot. There's no need for the government to get involved.
