NBC - In a potentially lethal blow to Obamacare, a federal appeals court has ruled that the federal government may not subsidize health insurance plans bought by people in states that decided not to set up their own marketplaces under Obamacare.
The law clearly says that states are to set up the exchanges. But 34 states opted not to, and the federal government took over in those states. The court ruled that federal government may not pay subsidies for insurance plans in those states.
I’m not sure why anyone thinks this is the end of Obamacare? The next logical step in the”progression” ( notice the quotes around the derivation of the word progress?) is full blown federal health care.
Can’t you hear them? “All these people have invested in Obamacare. We can’t throw them to the wolves. We have to pay for it all!”
I live in GA, which did not create an exchange. I saw my dr. yesterday. He said Obamacare is working great in GA, & that during the next open enrollment I should sign up. Naturally, his premise for the boondoggle working well in this state is that the subsidies are in force. So what I infer from this article is that, should appeals fail, we’ll have no subsidies in GA?
If someone can confirm that I have the gist of it right, I’d appreciate it. Thank you in advance.
[Btw, I am rabidly against Obamacare. That’s just one reason I haven’t signed up.]
(Reuters) - A U.S. appeals court on Tuesday threw out a federal regulation that implements key subsidies that are vital to President Barack Obama’s healthcare overhaul.
The U.S. Court of Appeals for the District of Columbia Circuit accepted one of the main legal challenges to the policy by conservatives opposed to an expansion of the federal government.
A three-judge panel returned the case to a lower court with instructions to rule in favor of appellants who had sued to overturn the rule.
The ruling has the potential to cripple the implementation of the law by making health insurance unaffordable for many people. If the Obama administration appeals, the case could yet end up before the U.S. Supreme Court.
And, folks, this court decision comes in just as it was reported yesterday that Obamacare premiums are set to skyrocket by as much as 25% in nine states next year. The Regime did not expect to see this horrible news come out before the 2014 midterm elections.
Obamacare could well be on its way to a slow death of 10,000 cuts. Clearly, this is not a good day for the America-hating Communists.
“BFD, so sue me,” Barack Hussein Obama.
Wet blanket warning...... There are a lot of powerful people heavily invested in 0care. Court orders, laws, the will of the people hasn’t affected them up until now.
And then there are the states like Oregon, who couldn’t make their website work despite $250 MILLION spent on it, who’ve had to fall back on the federal website.
I’m going to enjoy watching this thing go up in flames.
Of-interest ping to SCOTUS list.
Little King Barry will just ignore Article 3 (Judicial) rulings that are NOT in his favor. I see the Admin will appeal, but this turkey NEEDS TO GO DOWN AND NONE TOO SOON.
I guess I’ve become jaded, but I see Obama simply saying, “How many soldiers does the Court command?” and going to play golf.
Off the top, does anyone have the list of the 34 states who did not set up Obamacare .....who opted out
I am guardedly optimistic. Very guardedly.
We are no longer a nation of laws, but of edicts. Relying on a Supreme Court decision is looking to the wrong authority for assurance.
No worries. Roberts will rewrite the law so that it can still torture the subjects. That is how he rolls. If the legislature does it wrong, he becomes the legislature. The four Liberal clowns have no compunction to lie and steal as they are Liberal. They will go along with anything that reduces the citizenry to slaves of the Central Planners.
Opinions (3 of them) are at:
“I have a pen, and I have a phone” can just declare the subsidies as legal — just like the other changes he has declared to the law since it became ‘settled law’.
