erhaps Perry and the bright minds of Texas have figured out a way around that pen —

Texas is slightly different than other states in the Union. Texas was an independent republic in it's own right when it won independence from Mexico.

When they joined the United States they kept their National Guard more independent than the rest of the States and it's not so easy for the President to demobilize the Texas NG by simply federalizing them.

Interestingly enough, Arizona and California National Guards were mobilized for action and were faced off against each other at the Colorado River over a water dispute.

The President at the time put a stop to that by nationalizing the Az and Ca NG units. The conflict lives on in the form of the agricultural checkpoints at the California -Arizona border.
