Boehner: House Has No Plans to Defund Unconstitutional Acts by Obama

House Speaker John Boehner (R-Ohio) indicated today that if President Barack Obama takes actions that exceed his constitutional authority, the House of Representatives has no plans to use its own constitutional authority to withhold funding from those actions.

At his weekly press briefing, CNSNews.com asked Boehner: “You’ve said you disagree with calls to impeach the president over abuse of power via executive actions. But under the Constitution the House actually has the power of the purse. So, if the President takes actions that exceed his Constitutional authority, will you withhold funding for those actions in the next must-pass appropriations bill?

It’s as clear as the nose on your face: Boner and his colleagues are okay with the way things are going. If I was the judge in the Boner lawsuit I’d dismiss it in a heartbeat on the grounds that the House already has the ability to rein in the executive through the power of the purse and/or impeachment.

What melodrama. Chains of slavery if a Republican wins? No offense, but that’s nutz. If you really want to know what chains of slavery will be like, try another 4 years of a Dem in office. Our country has almost been ruined under 6 years, going on 8 of Obama. And you think the country will survive another 4-8 years of commie/fascist/socialist rule by Dems? You jest.

It will put the nail in our country’s coffin, if we don’t end up in some major war again with reduced military capabilities because Dems hate the military. Pubs don’t hate the military. Dems do. If you don’t think there is any difference between Pubs and Dems, you are, pardon the expression, demented. You risk your whole country based on your misbegotten purist stance. The end of the American Empire as we knew it. Hope you don’t have any kids or grandkids. I’ll be long dead, but they will suffer, and if you are young enough, so will you for your pigheadedness. Pigheadedness? Or Patriotism? The R's won't fix any problems in this Country. They will, more or less, take us down the very same road the D's are taking us, a little slower. It's kinda like ripping the band aid off real slow and painful like. I'd prefer to rip it off fast so we can get through the pain and suffering and focus on recovery. That, my FRiend, is the only way we'll get our Country back.

By that time, it will be too late for recovery, my FRiend. 4-8 more years of Dems and they will have rearranged the demographics in this country such that there will not be another Pub Prez. But being myopic, you can’t seem to see that. I understand your frustration, I don’t understand your lack of practical, rational political thinking.

He thinks he was defeated in the “government shutdown” last year and won’t do it again no matter the degree of tyranny that is at steak.

The really sad part is, politically he may be right, With most of the population getting their news from people like John Steward, while living on welfare checks there is no more a possibility justice than there is honesty from those sources.

We have to take John Stwerd and other leftist media icons out of the limelight. Our own Message has to make it thou somehow or this country will simply go to hell with these people doing everything they can to cover up anything that suggest why.

“Now, when it comes to that issue, some of these actions that you could defund, there clearly isn’t, I wouldn’t guess, an appetite in the United States Senate to withhold those funds,” Boehner continued.

Boehner obviously doesn’t understand he doesn’t have to have the permission of the Senate to defund a program or activity. Appropriations bills begin in the House. The Senate can only act on funding approved by the House and sent to the Senate. If the House doesn’t appropriate funds for an activity, the Senate has no power to approve or disapprove what isn’t there. It can only act on the bills it is sent.

To play this game effectively the Republicans need to stop sending the huge omnibus spending bills to the Senate. Send individual appropriations bills for each department, or even major programs. The Senate can either approve or vote down the individual bills. If the Senate votes down the entire appropriations bill for the EPA because the House didn’t include funding for some pet environmental project of Obama’s, the EPA simply is not funded. Boehner and the Republicans need take no action and they can blame the Senate for deliberately voting not to fund the EPA. Trick the Senate into doing same thing with Labor, Education, HUD, Transportation, and HHS and we could make a real dent in the deficit which would be good for America.

Boehner either agrees with the Senate and Obama on spending needs or has no stomach for a fight where the Constitution actually gives the House the upper hand. He is both a poor strategist and horrible leader for an opposition party.

I have no idea what propaganda you’re referring to. I said nothing about anyone being adversely affected by the government shutdown.

My point was that given the current makeup of our government makeup, “power of the purse” = “government shutdown”.

In order for you successfully effectuate “the power of the purse” you would need to do the following:

1. Accept the eventual shutdown of the government, which the democrats would do in a heartbeat

2. Embark in an articulate, passionate and convincing enough PR campaign to convince the majority of the people and the media that:
a) it is the democrats who are responsible for the shutdown (which they are) and
b) that cutting the expenditures that you’re cutting (i.e., “exercising the power of the purse”) is in the best interest of the country.

If you’re successful in doing 2, it would force the democrats to back down and you would then have been successful in exercising the “power of the purse”

Do you think you could do that? Do you know anyone in the GOP who could pull that off? And if they fail, what are the consequences?

Many people here think that “the power of the purse” means all the house has to do is cut or not fund a particular program and it’s done. But it’s not that simple - the Senate and the president have to go along - if they don’t they can shut down the government and then you have to deal with that. As things stand today, the republicans will get the blame from the american people whose majority today is composed of liberals and ignoramuses. Unless you can effectively counter that, you’re playing a loser’s game.

If you think this analysis is flawed, let me know where.

I like the constitution a lot, but it carries little weight when many of the leading politicians and the majority of the people are either ignorant of it or don’t like it - which seems to be the case today.
