I don’t know about the heavily trained. Many states have codified the right not to have to retreat before reacting to a threat. I’ve never heard of that in WV. You screw with someone, as in threaten their life, and you defend yourself. I don’t know of any incident of true self defense, that a prosecutor decided to go legal in this state.
I could be wrong, but the few incidents where charges were filed were situations in which there was reason to indict and try.
