Whenever a law is made, and is not challenged as to its constitution validness, regardless of whether it passes muster. This is likely why Obama is not being challenged on the things he does because both parties would like a President who is less restricted by the Constitution and more like an imperial monarch.

I meant to add that when laws aren’t challenged, they become valid regardless of their validity under the Constitution.
