A Montana couple frustrated by recent thefts allegedly set a trap for potential burglarsand upon hearing a would-be intruder after midnight on Sunday, the husband fired four shots into the darkness, he says. Now, Markus Kaarma of Missoula has been charged in the death of German exchange student Diren Dede, 17, who was hit by bullets in the head and arm, the AP reports. The couple had set up sensors and cameras around their garage, whose door they left open; Kaarma's wife, Janelle Pflager, left her purse there "so they would take it," she said, per court documents. She reportedly told police the couple had been robbed twice in three weeks.
Documents say Kaarma, 29, told a hairstylist last Wednesday that he'd been waiting three days for another burglary, shotgun at the ready, the Washington Post reports. "Im just waiting to shoot some [obscenity] kid," he allegedly told the stylist at Great Clips, which ended up calling police over his profane language and unruly behavior, Raw Story reports. Kaarma was yesterday charged with one count of felony deliberate homicide; it's unclear why Diren was in the garage. Billings, Mont., saw a similar shooting hours before Missoula's: A homeowner shot a seminary student described as a "house guest" who was making a call in the garage. The student is expected to survive.
I am tentatively in agreement with you - Here, one can only use deadly force while one is under threat - The local wisdom here is to make the first round count, because thereafter, if the perp is merely incapacitated, one is obliged to render aid, if possible, and perform an holding action under the more limited options of a Citizen's Arrest.
But that can't be set in stone either - I am trained to double-tap, reset, double-tap... So it is quite conceivable that an intruder might develop several perforations more than he used to have in the matter of a few seconds as a matter of course... Any Sheriff Deputy hereabouts is going to understand that sort of thing intrinsically, and would probably applaud (providing the groupings were tight).
And mindset has somewhat to do with it too - Anyone who had cased the joint would know he is going up against a redneck boy - If he wants to go ahead anyway, he is already a heightened threat... And if he gets through the dog too, I can guarantee he would be met with extreme prejudice. I have to figure that isn't some tweaker out to lift a tape deck, but rather, an extremely confident and dangerous opponent. Giving warning or quarter in that case would be fairly far down the list of executable options.
And I don't think there is a DA in Flathead County that would care to oppose that view, not to mention 12 citizens that would agree with him.
Who are you to perform his threat assessment? And I might point out that most dangerous things like lurking in darkness.
Is it wise? No. Do I blame him for going off? no.
That is criminal.

True. But a slug ain’t a bullet and one does not “spray” an area with slugs...unless he had a serious semi-auto shotgun, which is doubtful. If it were slugs he fired, there’s a good chance he’d have never hit the kid. But, all supposition. Including the supposition that the writer could use some schooling in ordnance terminology.
But WOULD probably kill his girlfriend back in the house as well as the neighbor in HIS house.
But then, should you walk through a "bad" neighborhood, be assaulted and defeat the assailant, resulting in his death, the lefties will claim that you set him up for the kill. Even if you can't be proven guilty the legal fees will bankrupt you.

A normal length shotgun doesn’t scatter as wide as some might think. At 10 yards/30 feet (imagine 5 six foot men lying end to end) the spread of an effective pattern is not going to be much more than a foot.
Its not like you can just point the gun at the room and hit everything in it.
So you can be amazed at what you can miss with a shotgun. I do it all the time at the range. And don’t even think about talking to me about dove shooting.
