The Commissioner was asked in the Press Conference what by law or constitution article was breached and the Commissioner declined to answer saying only that he had the OK from the lawyers.
It's likely very vague, at best.
This has lawsuit written all over it.
This seems to me like a rush to judgement.
This whole issue first hit the news on Saturday, becoming a firestorm over the weekend.
Here it is Tuesday afternoon, 3 days later, and we already have a judgement, fine, penalty, course of action set. 3 days is hardly enough time to do any thorough investigation, including the fact that this girl probably illegally taped conversations, background checks of the girl, Sterling, and any others involved, whether the NBA can be sued by anyone for imposing the penalty, etc.
I really would expect a longer investigation, rather than what appears to be a rush to judgement.
I suspect a quiet deal will be worked out where Sterling gets a bit more money, Magic gets the clippers, and everyone goes away quietly.
A lawsuit would be damaging to everyone involved. No owner wants to have to go through discovery, and the court of public opinion has already branded Sterling as a racist (which he probably is, but that is not the point). Also think of this. Holder could order the DOJ in for civil rights violations and hate crimes if Sterling puts up a fight.
So there will be no lawsuit.
I read the NBA Constitution and Bylaws. There is no provision that supports what the Commissioner did today. See the link in my post #404.
