You're both wrong. While the militias belong to the ‘various states’, which appoint their officers, Congress determines their equipping and discipline, and ‘determines the conditions for calling up the militia.’ The President, as Commander-in-Chief, commands the militia when it is in Federal service. Moreover, the Draft registration is, in effect, a National Enrolled Militia, subject to call up at the discretion of Congress.
The US Constitution, and the Constitutions and Militia Laws of the various states make it clear that the militia is a part of the state, or rather of the nation and the people. “We the People of the United States...” Remember?
