Congress has already ruled. e-vapors are taken into the body, so whether you call it a drug or a food, or a tobacco product, the FDA has congressionally authorized jurisdiction.
What a monumentally stupid statement! Oxygen is taken into the body, so... ...Congress must have also authorized the FDA to regulate that!
