Or that she wasn't impaired? She was accidentally driving while being accidentally impaired... and accidently caused an accident.

Both sides agreed that she had taken the Ambien by accident. The State’s only case then was to prove that she had plenty of warning to pull over as the pill took effect. But she was too high to realize it. Once the prosecution agreed that she took the Ambien by accident the case was over- unfortunately.
