Who has the proverbial and legal standing in all of this?

WE, the People, that's who!

Like you most assuredly and resolutely stated,

We must resist or lose our Republic forever. We are at war against the leftists (or rather they are at war against us).

We cannot permit Boehner to move OUR House into Immigration Reform in this Banner 2014 Election Year!

Free Republic must again take our activist lead into the trenches. We have a Republic to save and restore!

Yup. We the people are the sovereigns. We have the first and final say in all things constitutional. The government serves at our consent. They need to study the Declaration and the Constitution. Our forefathers set it up and gave us final recourse when unlawful tyrannical government tries to take over.

The Constitution is headed up in big bold letters with:

"WE THE PEOPLE."

As sovereigns, We the People first organized as states and later WE established the federal government to serve at our consent. And we established it with very limited enumerated powers and very strict defined rules, reserving all other powers to our states and ourselves. The federal government is NOT our RULER and NEVER has been and was NEVER intended to be!! It obtains its just powers at our consent. Historically, We the People can tolerate only so much tyranny. And I think we're there again. Obama is busily burning the federales last bridge.
