Your argument seems to boil down to “they should have to be better trained to exercise a Constitutional right.” I strongly disagree. And this completely ignores the aspect of Terry stopping those without guns simply for being in the company of those who did.

If they were unholstering and truly brandishing their firearms, that is an issue. But that doesn’t seem to have been the case here, and speculating on something like that when nothing indicates anything of that sort went on, merely to give excuse to the cop for his questionable actions, isn’t much of an argument. The point here is that law-abididing citizens, as these appear to be, shouldn’t be subjuct to being detained, and IDs demanded of them, for no reason other than someone saw them open carrying and got the vapors, and called the cops on them.

A friend of mine walked into a restaurant he frequents and they had a hand-drawn pistol with the circle and crossbar for “no guns allowed” sign behind the counter.

The proprietress explained that was for the new NC law forbidding handguns in places that serve alcohol. He explained that the new law for the first time ALLOWS CC in such places.

But he said, “Let me ask you a question. If your ex-boyfriend came here in a rage with the intention of killing you and maybe a few bystanders, do you think that piece of paper would stop him?”

“Well, no.”

“And I will be sitting at that table. Since I respect your rights as the property owner, my gun that I have right now on my person would be sitting in my vehicle. I wouldn’t be able to help you at all. But if I had my weapon on me like I do everywhere else I could probably surprise him and prevent him from killing you and a lot of others “

She took her sign down.

Many states don’t require a permit for open carry. Only for Concealed Carry.

So, does your residential state override the state where you are carrying? And, how would a cop know that unless they stop you? And, if you are not doing something illegal in their jurisdiction, why would they stop you? I am very confused.
