IMHO, unless Congress acts quickly to rewrite the act that they passed, this is an impeachable action.
A POTUS can't pick and choose what laws he will enforce. He is bound by his oath to enforce them all.

It was obvious where he was going when he decided not to enforce DOMA or immigration laws.
And congress merely yawned.
It’s not naïve to expect congress to do their jobs.
