You make the point for my post #24.
In your example, something of value was/is transferred as a direct result of the misrepresentation.
I am not a lawyer, but I believe I am correct.
But as I said, lawyers will argue both sides of any subject you can name, so long as you can pay their fees.
If you read up on Saul Alinski, obomas mentor, you'll know Alinski saw the middle class as the enemy. Yet, oboma "claims" he does what he does to "help" the middle class - another lie.
Look around. The wealthy are raking in the cash. The wealthy donors and obomas buddies are rolling in dough. The welfare base is collecting free handouts like kids trick or treating.
Who's really getting hurt? The middle class. Higher prices, higher taxes, oppressive regulations, and obomacare. They're carrying the entire burden. Eventually, there won't be any middle class left - just like Alinski (and oboma) wanted.
..the use of deceit or trick to cause someone to act to his/her disadvantage; This does not require direct benefit to the person committing the fraud nor even actual damages to the victim.
A person offering to grant riches to someone in exchange for a signature on a document offering their soul in payment would be a fraud with no benefit or damage.
