A substitute teacher, as I understand it, is there on a per diem basis. Pretty much at the pleasure of the school administration. They don't need an ‘acceptable’ reason to not use her services.

But they can't discriminate based on gender. Firing her and not the fiance will very likely lose the lawsuit for them.

True, but full time teachers in a union, especially if they have tenure, are all but untouchable in many districts around the country.

I distinctly recall a cell phone audio of the head of the NYC (or maybe Long Island) teachers union saying now that negotiations are over, a tenured teacher has to literally get caught f**king a student in the hallway to get fired. She said it with a high degree of confidence to a gigling teacher audience.

I don't know the situation with this other guy - but my bet he has union protections that a substitute does not.

Still, I did say in my original post that I personally think they both should be fired at any rate. I noticed you left that part out.
