Um... right.
I guess we’re supposed to believe that poor performance by minorities on standardized exams reflects a cultural bias of the exam, and is not a result of cultural influences that ostracize and punish achievers of certain races.
Instead of attacking the messenger (the exam that reveals cultural failure), why doesn’t the Justice department attack the culture that labels achievers as Uncle Toms and encourages laziness and failure?

They cannot do that, because if they do, their whole worldview, that made them very rich and very powerful by promoting these lies, is undercut.
So they cannot and they will not.

Actually, the Justice Dept is making the same exact case you are in their argument here.
The key point being made by them is that the tests "continue to have a statistically significant, disparate impact on African-American test-takers".
Note that in saying that they aren't claiming that the tests themselves are explicitly/verifiable racially discriminatory or racist. Which, if true (and its not), would be a legitimate argument calling for input control measures.
Instead, the Dept of Justice is pointing to the output/outcome side of the equation. The tests may not be racist in and of themselves, but they don't support the OUTCOME of hiring/promoting the desired number of blacks.
This is a tacit admission that blacks are, indeed, lower achievers (which is CULTURAL and not race-based) than whites and that the only way to support the desired outcome in hiring/promotion is to dumb the tests down so they can pass.
