No, you misunderstood.
They claimed that he retired, in which he could not be forced to testify.
If he is still on active duty, he is still a government employee and CAN be forced to testify.

Congress has shown that it is completely unable to protect whistleblowers. They may hold a hearing, sound stern, huff and puff, but the Obama Regime just does what it wants and Holder wears his Contempt of Congress citation like a badge of honor. At this stage, I don't think any House hearing or disclosure will make any difference.
