I wonder if the defense can file an appeal before the closing arguments are finished. If so, I wonder if some legal scholars would be sending in draft appeals to the defense team as I type. The defense does not want a mistrial. They want a verdict. They have more than enough ammunition for a later retrial, but if an appeal were granted at this point the only remedy would be a new trial.

Oh. I did not know filing an immediate appeal would lead to a mistrial. If that is so, then imaginably you are correct.
