Technically, it is a motion for judgment of acquittal, not for dismissal.

O'Mara might (and could) move to dismiss based on immunity, but I don't think he will.

Motion for judgment of acquittal is routine.

And very rarely granted, even when it probably should be. Judges in general are loath to take a case away from a jury at this point.
