attorneys are under oath all the time in court as officers of the court.

Is judge bailing on prosecution?

He’s probably swearing that he did not know about Bao’s notes and what is in them — and what is in them must be devastating.

I think Bao is going to be looking for a new job and an attorney.

They are officers of the court but they are not always, in fact not usually, ‘under oath.’ What they say is not testimony exactly because they are not under oath, unless as here they specifically take an oath.
