Well, it used to be in the power of a state. That changed in wickard v filburn, and then Scalia confirmed it back in the 90’s. Diaz or something like that.
I think that was Raisch, back on 2004. GWB claimed to support an "original intent" interpretation of the Constitution during his campaign, then sent his DOJ lawyers before the USSC to argue upholding Wickard v. Filburn. I was disgusted.
