Yep. His argument is senseless and the lower court verified it. He isn’t the first nutcase to try this idea. He should have watched them and learned.
“This guy is going to jail.”
Maybe not, there is no law you have to pay taxes, lots of folks pay no taxes I believe the law is you must file and there is no time limit on filing so if the IRS comes after him he simply files those returns - he then may or may not have any tax liability.
That’s probably why the Southern states are all going to dump income tax. It is illegal anyway. The Northern States just want someone to tuck them into bed at night. :) They will give up anything to feel safe, so they don’t mind handing over their paychecks.
My wife works for a CPA. Refusing to file happens more than I thought and it usually involves people who know better. They are counting on the mercy of the IRS.
As long as you are paying them, you are OK. Not paying and not filing is a good way to go into a lot of debt.
If it was illegal, it wouldn’t be legal. You might want to think on that.
The IRS likes to make landmark jail sentences to scare the rest of us.
In the Sacramento area a business owner was taking $50.00 per week from the cash till for personal use. He ended up with a five year jail sentence. He could not plead down. Landmark.
Even if there is no withholding, they got you with 1099s and bank deposits. You have to file.
It's getting harder and harder to go 100% cash. Just about every hooker prosecution has a tax angle. The pandering charges are dropped, but they deposited cash in their bank account without tax filing returns.
Unless there is mass disobedience, the IRS will always win.
I can smell them fish frying, even now... ;-)
The irs fears no one. It is perfectly situated to totally destroy anyone who it wants to destroy. It has knowledge of all your finances. Your passport is tied to your universal personal identifier (formerly known as social security number)
In some states, you driver’s license is too.
If it decides to destroy you, it will be easy.
Not filing tax returns is a stupid idea.
It isn’t legal. It is just enforced.
There are also things which are legal, and NOT enforced. There is a difference between what is legal, and what the Federal government does.
Are you just finding out about that?
I don’t think you now the meaning of the word “legal”. Income taxes are perfectly legal and it’s been proven every time someone tries to disprove it.
It's what the taxpayer the article is written about is asking the Courts and IRS to define (i.e., are wages income?). He cites a case in the past were the court ruled that it wasn't income, because your labor is considered an expense to you.
I'm no expert in these matters, just trying to clear up what's being presented in the article linked.
If 100 million or even 10 million citizens spread all over the country refuse to pay the income tax, what would they do?
If you do not pay your taxes, you will go to prison.
Arguments to the contrary and phoney baloney tactics are like a thicket of reeds against the IRS's sharp machete. Once cut down and pushed aside, nothing will stop them from putting you in prison.
The concept of income tax is unconstitutional, for a starter. Secondly, it was brought about by lying to the citizens of the USA that it would only be paid by the rich and would never exceed 3% of ones income.
Of course, if lying to the taxpayers was actually grounds for nullification of bait-and-switch federal laws, ObamaCare would be on its way to the scrap heap.
I pay all of my taxes, because it will be held against me and enforced IF I don’t. I do not believe income tax is legal, nor has it been proved that it is legal.
I do expect that my State will drop the income tax, along with other Southern States. I know for a fact that part of the reason the Legislature is promoting dropping the income tax is because it is “illegal” to tax that money twice.
Northerners are such pansies its surprising they still can breed on occasion.
Is this the same individual wardaddy was posting about?
