I’m not a lawyer, but I agree with Gowdy. Issa blew it. He should have kept Lerner there all day and made he take the Fifth on every question. WTF is wrong with that guy?
He dismissed her, subject to recall, so they could get a legal ruling, in essence, to force her into testifying. She claimed she did nothing "wrong", then took the 5th. Think about it, she was just following orders from above - ergo, she did nothing "wrong". But if she didn't take the 5th, she would be asked who gave the orders and then her jeopardy would kick in - Chicago style.
I believe Issa is merely a thief and a thug. Not much else.
A shady character in my view. His record indicates the possibility of taking economies with the truth himself.
The committee knew in advance that Lerner would take the Fifth.
Issa and Gowdy have worked together very closely thus far. And both have recognized the need to pre-plan the hearings' conduct for maximum impact and information.
I'd wager that their pas de deux was pre-planned as a response to precisely what happened -- a self-righteous statement of innocence followed by an assertion of the Fifth.
Lerner's legal status under the circumstances will now be definitively determined and she will be recalled -- and either forced to testify or under some negotiated immunity.
She's not out of the woods.
I agree, and from what I just heard from Rush Limbaugh, he agrees as well. Rush thinks Lerner is going to get away with it... this sucks.
