Top IRS official will invoke Fifth Amendment

Here is a true story when the 5th was proper:

There was a Democrat District Judge who was indicting every Republican office holder on anything she could make up. She brought in a lawyer from another town with the stated purpose of investigating Republican office holders until he could charge them with something. Then, she chose a grand jury of her actual family relations and personal friends. I coudn’t believe a judge did that but she did.

A Republican friend of mine was called before that jury and she knew nothing bad about any Republican office holder. She told the truth and members of the grand jury told her they didn't believe her - that she was lying. They called her again and she told the truth and they said they didn't believe her - that she was lying. They called her again, but we had talked and decided the best thing to do was to take the 5th so they couldn't even get the truth again because they were not going to accept the truth. So, she went in and took the 5th. That blew their minds and they didn't call her again.

I knew they wanted me and I wasn't going in there and be treated like that, so I stayed in my house out of that town. Since I couldn't be found, I was never served. I surely would have taken the 5th and probably spit when I said it. I knew our Republicans were not guilty of anything. The brought in lawyer did prosecute those office holders on such bogus charges it was laughable if it hadn't been so serious. In every case, they were found not guilty. You simply would freak out if I went into those cases.

Because that district judge did that, I now know Democrat judges are crooked as hell. I lost all respect for judges if they are Democrat. She belonged in jail for that.

If you think Democrat judges are impartial as they should be, forget it. I would never live in that county again.

Likely she’s trying to get an immunity deal before she says anything. I hear they do that a lot in federal practice.

Before getting an immunity deal, Issa will require her lawyer to tell him the general nature and contents of her proposed testimony.

Once given immunity, she must be totally honest or the deal is void. Can’t be mostly honest; it has to be total and completely truthful. Parsing doesn’t work.

That's the other side of silence. You can be silent all you want, but that doesn't stop the prosecution from getting other witnesses and having them tell the story, entirely unopposed by you because you are silent.

If the prosecutor goes low enough s/he will always find a worker bee who saw and heard something and who has neither a reason nor the right to remain silent. 5A only allows you to not be a witness against yourself. You cannot remain silent about someone else's crime; that may earn you a few conspiracy charges. I recall that in Clinton's days someone spent a good time in jail for refusing to speak about other people's deeds (that was contempt of the court.)

BINGO...
A simple Google search will tell you that despite that FACTS, almost every media outlet, EVERYWHERE is blaming a BUSH-APPOINTEE for this, and no else. It’s all good because a Bush appointee was the acting, temp head of the IRS when this happened.

We get NOWHERE until we can get above the din of an intimidated/biased media, vs people willing to use the power of the government to keep them in line.

The DOJ is also investigating this case. How corrupt is the DOJ? Maybe she could get immunity from Congress for charging her with something, but would any sane person trust what amounts to the secret police to tell her story to?

There needs to be an outcry from the public and Congress to appoint a special prosecutor. Only Obama can do this.

Be careful if you give her blanket immunity she can just take the fall for everything. We need to only give immunity for things she reveals while exposing higher ups. So limited immunity only.

Exactly. Ask her When did Obama direct her to take action against conservatives that were aligned against his re-election effort.

Then she pleads the 5th. Then ask her if any Rat that’s up for re-election in the Senate knew about it. Have her take the 5th. Then play that for your elections against those guys.

use immunity - an exemption that displaces the privilege against self-incrimination; neither compelled testimony or any fruits of it can be used against the witness who therefore can no longer fear self-incrimination.

No immunity. She’s a witch. Buuuurn her!

I agree, but I'm wondering how you can claim the fifth in order to not testify at all. I can see claiming the fifth in response to a specific question or questions, but not to avoid a subpoena.
