I know this is not the popular opinion here but he should have been read his Miranda rights from the git-go. He may be a dirbag terrorist, but he is a US citizen and must be afforded due process. If they can pull this crap on him they can pull it on any of us.
Is he a citizen? I thought he was still on a visa of some sort.
There was much discussion over whether he should be considered an “enemy combatant” and therefore not required to be ‘Miranda’d”.
If Djirtbag took the following oath with reservations, did he become a citizen?

Absolutely right! While I don't like the easy process by which Tsarnaev became an American citizen, the fact is that he is a naturalized citizen and is therefore entitled to every right thereunto pertaining until he is convicted of the crimes for which he is charged.
Wrongo Bongo. He is a freaking terrorist and was afforded all health care rights as a US citizen but the public exemption act was in place and this beyotch had him awakened so he could be “mirandized”. You can’t be questioned in a48 hour period if you are unconscious due to administered drugs.

If only this dirtbag terrorist wasn’t citizenized under false pretenses I’d have to agree.
On the other hand, continued interrogation could have yielded more useful information about others involved, including connections to people in or close to the regime--which is why the judge was sent in to shut him up by reminding him to "remain silent."
And, he hasn’t shut up since being read his rights. Additionally, he and his idiot brother confessed to a third party who can testify, the carjacking victim. Most defense lawyers would try to exclude anything said prior to him being read his rights. He’s going away forever, if not being put to death.
They filed charges. Charges are followed by a preliminary arraignment. The magistrate reads a colloquy that includes informing the defendant of his rights to legal representation, bail and to remain silent. It is pretty much a standard script.
I guess the FBI guys never arrested and arraigned anyone before or they would have known this. Holder had nothing to do with it. It is legal SOP. The US attorney. Should have thought through this if they wanted to deviate from the normal rule of criminal procedure.
