He got his citizenship on 11 Sept 2012. He is a US citizen. I hate this azzhole with all my being, but he must be afforded due process. Again, if they can pull this crap on him, what will stop them from doing to any of us? We either stand for the Constitution 100% of the time or we don’t. You choose. I’ve already made my choice.

Likely as not, he’ll be given a plea bargain,
there will be no trial, no open questioning,
no cross-examination.

The whole thing will be considered closed.

And whatever version the government wants will be the one
that goes into the official histories.

(Think: Sirhan, Ray, Oswald, Benghazi, Fast and Furious,
Ft.Hood)

If he was declared an enemy combatant, and such determination was upheld by a hearing, he could have been tried in a military tribunal. Due processes without a Miranda warning. Even then he still could have been sent to criminal court had the Feds so chosen.

Instead, Obama chose the direct route to stopping intelligence gathering and a fast track to the slow road of endless legal rangling and appeals.

I heard a former DoJ prosecter from Bush's term explaining the legality of this on Saturday night and he was saying how there was a way to consider him an "enemy combatant" but the administration would certainly not use it.

So- he fully expected the man to be Miranda'd and for him to do exactly what he just did: clam up. And- it went down EXACTLY as he said it would. Not sure it is as cut and dry as you seem to think it is. There are circumstances that when public safety is immediately threatened, the Miranda laws do not apply. I forget the exact term for it.

So, for instance, if the bomber had friends that were conducting more life threatening actions- like bombing trains in Canada to the U.S., we theoretically had every right NOT to Miranda him due to the clear and present danger. Now that we have, he can do more damage, simply by saying nothing.
