Believe it or not a lot of retail FFL's are in favor of this. There are allegations that SAF listened to them. We have had this crap in California since 1975 or so and seen the problems this sort of legislation entails.
There is no requirement for an FFL to conduct the check. Many will simply refuse to do them for private party transfers (PPT). CA had to make it mandatory that they do so. Even today there are problems with some gun stores that make people in there for a PPT wait until all other customers have been served. Many people have waited for hours or left for another store.
The fee for a transfer is not capped. As the bill reads an FFL can charge whatever they want for this service. CA capped the fee at $10, which is added on to the state fee of $14. It would appear that $10 is too low so you get the incentive for behavior described above to legally not conduct a required service. Right now dealer prices to receive a firearm for a customer are all over the place from a low of around $40 to upwards of $150, often done to make firearms in stock competitive.
The CA fee for this service, called Dealer Record of Sale (DROS) is $14. That is too high as over the years the Department of Justice accumulated a huge pot of money. When the law was passed it said that if a surplus accumulated then the fee will be lowered. Predictably they are now raiding it for the General Fund.
There is no requirement, or judicial resolution, if the check cannot be completed, for any reason.
California has a 10 day waiting period during which the checks are completed. During the recent rush to buy firearms they fell behind. Did they transfer more workers to handle the load? Of course not, that would cut into the surplus. So the vehemently anti-gun Attorney General (and Obozo favorite) Kamala Harris invented a "delay letter" that was not authorized in the law and thousands of gun buyers have had their purchases put on indefinite hold - many over 90 days.
Then it turned out that the CA DOJ computers were lacking the information on the resolution of an arrest. That is a person was arrested and then released and charges dropped and the arrest was reported and the release was not. So where the disqualification was a felony conviction it de facto became a felony arrest unless they knew about the dismissal. Then they tell the purchaser they have to straighten it out and get a letter from the local agency. Some guys take a day of from work and drive hundreds of miles only to be told that the agency destroyed the records years ago so no gun for them.
There are a lot of problems that come up with background checks and many of them are unforeseen. Do yourselves a favor and learn from California's mistake. Contact your legislator and stop this before it's too late.
It makes all checks now a perment record, takes away second amendment rights WITHOUT DUE PROCESS or court finding/order.

Does the bill live or die, and how does either result affect the gun control movement who has a long shopping list of things to go after? Does it motivate them or demoralize them for another Decade? Does this become to Dems what immigration was to the GOP ~ 8 years ago, or their 9-11 victory?
Part of that is if amendments restore gun rights to those libs states who took them away mandated on the Fed level, then the the gun control Dem team starts jumping ship. That is the big prize.

I know the strategy that got us VAWA 2013 with additions for gay and illegals did not work, except for Obama.
It was a disaster.
Maybe this one will go better(less better for them). Maybe not. Will see.

Losing the 2012 election didnt help any. Or some of the polls. In 2010 McCain said he gave up his immigration ideas, then in Nov 2012 after the election his dreams came true, he's back. "I told you so" he now says.
As I said earlier : the GOP seems much more opposed to gun control than amnesty, but we wont know till either a bill is passed or Obama stops talking about it. Notice the amnesty RINOs are all lining up against the Rubio version too : Rubio, Grahamnesty, ....where's McCain?.

Most Americans don’t know what this amnesty will do to our economy, and the eventual makeup of the population here.Thirty years in So. California taught me. If the rest of the country could see the cost, and results, politicians would be strung up.
