Congress can take care of the “anchor baby” problem by pointing out that children of illegal aliens are not fully “subject to the jurisdiction thereof” as child custody and divorce court proceedings probably would have to take place in their home country, in the event of any dispute.

Kansas Senator Jerry Moran has introduced legislation to declare that anchor babies are not really covered by the 14th Amendment, since they are not fully under the jurisdiction of US Courts/
