Those who argue that the investigation is ludicrous have a point: Showing an empty gun magazine on television, though illegal in Washington, D.C., was hardly going to harm anyone. As Fox News anchor Greta Van Susteren wrote, it's hard to think of a sillier use of investigative resources.
But it's also hard to blame the other side for asking that laws be upheld and applied to all -- especially at a time when so many in the media seem to be pushing for more of those laws.
The Gregory investigation may have started as a "non-story," but that's no longer the case. There are some folks on the right who still care about the outcome, and are ready to cite it as precedent if it goes Gregory's way.

BO’s appearance this Sunday, was at minimum, assurance Gregory is free from consequence.
Arrest him have him plead guilty and pay the grand, give him community service, and forget it!
If not he and the media will be viewed as above the law.
If that’s the case, the Magazine law will have to be changed!
And all criminals and charges from ownership of said magazines shall be released and charges dropped.
Or insist that if someone like Gregory breaking it needen't be punishable, then nobody should be punished for it, ergo, it needen't exist.

Greta, you moron, you know darn well that if I walked into your studio waving that same magazine, your people would have called the cops on me and I would have been hauled away. But no, you folks are above the law, so it's silly if it happens to you.
Having this here M16 “fire control group” (tiny trigger parts that enable full auto firing) that easily fits in the palm of my hand surely is not going to hurt a flea, but the BATFE will aggressively investigate an arrest anyone it catches wind of having one and the “crime” will be “constructive possession of an unregistered machine gun”
The evil offending parts will easily fit in a mascara case and weigh less than a subway rider’s pocket change.

POSSESSION of a gun magazine is a victimless crime, no matter who does it, when, or why. There is only a victim if the gun magazine is used to cause harm to someone, and no one is arguing that should not be illegal, as it always has been.
It's happened to me a lot.
Resident: We won’t see crime rates go down without a return to respect for morality.
Police Officer: I don’t care about morality. I only care about enforcing the law.
I figure it is a good test case: Magazine restriction infringes on my right to keep and bear arms by preventing usage of (Miller test) components suitable for use by militia. In the absence of government (strict scrutiny) evidence that shooting 10 people is ok, and 30 people is not ok, then 30 round magazines must be permitted.
And if we lose, only Gregory needs to go to jail.
