Senate Bill 736: Expand court authority over medical marijuana patients’ children

House Bill 5223: Reduce “student growth” portion of teacher rating criteria
Introduced by Rep. Margaret O’Brien (R) on January 15, 2014, to delay and change many details in the teacher evaluation criteria specified in a 2011 legislative package overhauling the “teacher tenure” and ratings system, which unless amended goes into effect in the fall of 2015. Among other changes the bill would reduce the amount of a teacher’s performance rating based on empirical student growth data collected by the state from at least 50 percent to 20 percent, with 30 percent based on “locally” selected growth assessments whose details and rigor may vary. Also, the requirement that a teacher who is rated “ineffective” three years in a row must be dismissed would not apply if any changes were made to the rating system during that period. The bill is cosponsored by Republicans Bill Rogers and Lisa Posthumus Lyons, and Democrat Adam Zemke.

Senate Bill 337: Revise business tax collection procedures and deadlines
Passed 36 to 0 in the Senate on January 21, 2014, to place specified limits on the personal liability of a business owner or manager for taxes the firm collects from another person but then fails to pay to the state. Also, to require the Department of Treasury to release a business’s known tax liability to a purchaser of the business within 60 days if the owner requests this, and limit the buyer’s liability for the firm’s unpaid taxes subject to various circumstances. Also, to establish that if the department initiates a tax audit it must be completed and the taxpayer “cleared” within specified time limits. Finally, to establish that if a claim for tax overpayment refund is not approved within one year, it can be treated as denied, and the taxpayer can appeal to the state tax tribunal or court of claims. Note: After Gov. Rick Snyder vetoed Senate Bill 64 following objections by the Department of Treasury to details in certain provisions, that bill’s other provisions were folded into this one. The measures respond to complaints from the business community that the department is being overly and unreasonably aggressive in enforcing various business-related tax provisions.
