Imagine, JUST IMAGINE, the huge battle in Congress if some President in 2016 were to nominate Judge Roy Moore to the SCOTUS.

I betcha ( with apologies to Sarah Palin ) there will be a fuss bigger than the Bork and Clarence Thomas nomination COMBINED.

Moore is a hero to many on the Right because of the 10 Commandments issue, but he is very liberal on the civil-justice issues that make up most of the courts' work. His campaign this year was funded largely by donations from plaintiffs' trial lawyers. He is not a friend to business interests in litigation.

There aren’t any good legal thinkers outside of Harvard, Princeton, Stanford and lowly Northwestern.

Why wouldn’t we see a more even distribution across law schools if the SCOTUS is supposed to be an American institution?
