The brother of a Navy veteran shot by a deputy in her own backyard wants the sheriff's department to admit its mistake and take responsibility for the incident.
Jennifer Orey, 36, was shot Sunday in a surprise encounter with two sheriff's deputies who were searching for a man reportedly in the area wearing a ski mask, the San Diego Union-Tribune reports. Orey was in her pajamas in her yard around 10:30 p.m. because she heard noises and thought it was her ex-husband, the newspaper reports.
Orey and Deputy Luke Berhalter came in contact and the officer's firearm discharged at point-blank range, her brother James Morgan told local Fox 5 News.
"He fired without warning, saying freeze, or anything. Then just as she saw the black smoke coming out the barrel she turned her body," Morgan said. "The bullet went through her chest and her left nipple, into her shoulder and out her pinkie."
The deputy reportedly told her, "I'm sorry, you startled me,"

I don’t understand what your logic is. They were gone when I got home how would a gun have helped unless guns can stop ghosts. I am a very strong supporter of the right to bear arms, but I don’t believe I have the right to tell others that they should carry. I resent anyone, particularly the government, telling me what I can and cannot do.
What if you had went outside instead Cowboy? I would bet if this had been happening at Noon the same results would have happened because the office was either paniced or startled and got off a Barney shot. It could have also been a kid coming home from work at Mickey'D's. Stupid of the kid then as well huh?
Believe it or not many women are firearm trained for self defense. If she had paniced & shot the uniformed officer outside her home thinking he was a burglar would you be here defending her? Somehow I seriously doubt it.
She thought her Ex was outside her home and felt safe enough to go check. That's why she went outside. Now obviously she was not scared of the EX as she would have not went outside right?
One of the most basic & fundamental rules in firearm safety is BE CERTAIN OF YOUR TARGET!!! The blame falls on the officer. 100%

The cop that shot her needs to go to jail. The remaining cops in that department need a LOT more training, starting with “DON’T TOUCH THE EFFIN’ TRIGGER UNTIL YOU HAVE A TARGET AND ARE READY TO SHOOT!”

Yep a lot of firearm rules were not followed. Thus the results as reported. You can have a weapon drawn and even in a pre aim ready to shoot holding posture. But keep the finger off the trigger so you don’t accidentally shot someone nor yourself.
This is the stupidest post I've seen since the arrest of that woman for videoing a cop while in her own yard.
Same cop comes into my backyard at 10:30 at night without knocking on my front door to notify me; is going to get real dead real quick, from ambush.
What you call common sense I just grew up calling YELLOW-BELLY COWARD. MY yard, my property, my constitutional rights, my call on who gets shot. Trespass is a crime and in the middle of the night, it is a shooting crime.
If they were gone a firearm would have made no difference. It might have made you think about staying in your home.
Some animals are “ more equal” than others......and when you add up the pay, bennies and pensions many LEO’s enjoy....society...We the People...have quite a bit invested in each.

The LOSER cop HAD HIS FINGER ON THE TRIGGER! It would have probably been fine to have the gun in his hand, pointed down. But NOT to put his finger on the trigger until he was READY to shoot! Poor training! SUE HIM AND THE CITY!

So much so that, just ACCIDENTALLY kill a police dog, yes, DOG, and see what happens!
The husband of our niece on my wife’s side had to appear in court today because drug agents appeared in his driveway in an unmarked car without a license plate and refused to identify themselves or leave the premises. He fired a warning shot which was a big mistake, he was arrested and spent the night in jail and who knows what the final outcome will be. I suppose he is lucky not to have been shot dead. He lives at the end of a quarter mile of dirt road but the agents claimed they were on a public road because there is more than one house on the road. Actually everyone on that stretch belongs to the same family and the county does not maintain it. They drive up not only in an unmarked car but with no license plate visible and refuse to say who they are but he is at fault according to them. I say legalize the damned drugs and stop this crap if this is the best they can do. Let the idiots who want drugs destroy their own lives and stop destroying the lives of those who don’t use drugs on the pretense of fighting a war on drugs.
