I doubt that’s true, but, regardless, if we had the votes to pass him through the senate nomination process, then we’d almost certainly have the votes to amend any legislation that would prevent him from taking office. It’d take a weird set of circumstances to keep him from passing through one way or another.
Don’t want him for VEEP though. He’s not on record about most issues that we care about.

What is your bases of my statement not being true? When Marshall was nominated to SecDef, Congress had to pass a special resolution. The purpose of the law was to insure that they would be no conflict of interest and that the Depart of Defense was run by a civilian.
