She said the officer "tried to throw him down, but (Herrera) wouldn't go down." That was when the officer spotted the butt of the weapon protruding from the teen's clothing.
"The cop stepped back and yelled 'Gun,' and fired," Williams said. She and Jones say they heard five shots.
Both said they realize Herrera was carrying a weapon. But "they could've took the gun off that boy," she said. "It shouldn't have happened like that."
It sounds like she will make a good witness for the officers.

This case: Carry a bigger gun.
Several years ago I was coming back from shooting at the range carrying a fully loaded pistol as I legally could with my CCW. Looked in my mirror and say the blue lights flashing. Pulled over rolled the window down and kept my hands clearly visible on the steering wheel. When the officer walked up I told him that I was carrying a legal firearm and asked him what he would like me to do.
I followed his instructions to the letter and there was no harm no foul.
But then again I wasn't a small time thug interested in being a jack wad.

17 year old mexican, with an assult rifle, refusing to follow cop commands. Im GLAD they blew out his lamp. Thinking of the innocent people he won’t victimize. Glad the cops went home safe.
Bet the neighbors wouldnt be lighting candles on a roadside memorial if he could have shot the cops first.

Funny how they never mention what actual weapon that was being carried by the deceased. If by “assualt weapon” they mean an AK-47 type or M-16/AR-15/M-4 type, my question is, how do you conceal it under your clothing, especially with a magazine attached, and given the light clothing probably worn given the summer heat?

17 + armed + struggling with cops = fatal mistake.
Even if us armchair cops out here think disarming him peacefully may have been possible, resisting cops is not a good idea.

From the responses I got on my post on an earlier thread; These “trigger happy’ cops should have waited until the late Ascencion Herrera pulled the weapon and then and only then disarmed him. Either by using Kung-fu(ey) or by shooting the weapon out of his hand. After all that is how Gene and Roy did it.
