You know, I would value Herman Cain’s viewpoint on this, and foreward strategy, much more than I would for ANY Mitt Romney advisor, no matter how seasoned or qualified.

If it’s a tax, it can’t be challenged properly until there’s an attempt to collect it.

The SCOTUS punted based on politics trumping the Constitution. Who knows what the rules are now?

Do the GOP have the balls to do it?? I know Demint, Toomey, Johnson, Lee, and Rubio have them. Does Romney have the spine to sign it?

Actually, they didn't. They said it was not a tax for the purposes of the Anti-Injunction Act, but it was "enough like a tax" to confer on Congress the power to pass it.

Since this "like a tax" non-tax is not an enumerated power of Congress, there is going to be constant litigation and appeals until the whole mess is repealed.

But your constant chanting of "it's a tax" does not change the reality that it is:

Not an excise
Not an impost
Not a duty
Not apportioned among the several States
and not a tax on incomes

So, it is most certainly not a "tax" that Congress has any authority to pass.
