Roberts has rendered the commerce claus meaningless. Now, as long as any law forcing the purchase of any product contains a tax (penalty) selectively applied only to those who choose not to comply then it is not a “mandate”
A mandate without a financial enforcement mechanism is unconstitutional, but if the government uses a “tax” to force complaince then it becomes constitutional.
If you drive a car, I’ll tax the street,
If you try to sit, I’ll tax your seat.
If you get too cold I’ll tax the heat,
If you take a walk, I’ll tax your feet.
