Rush is absolutely correct and my guess is he got a lot of his evidence from Mark Levin who has always been his lawyer and a close friend. I didn't get a chance to hear Levin's show last night but would not be surprised if there are some similarities.
Rush of course is not answering "why" Roberts did what he did.
The I want to go down in history stuff is pretty weak.
You have to ask what motivates Roberts and what motivated those who chose him be on the bench be it GW or others. Ask all those questions do some intensive searching and you will not like what is out there. It's so comprehensive it will take me all weekend just to absorb it all.

I haven't seen this anywhere (so I could be royally wrong), but I smell the stench of Laurence Tribe, the 10th justice--- mentor to Obama, Roberts, and first-name-basis buddy of Kagan's. Roberts was judicially seduced.

It's not really that complicated - it's just another naked power grab and Roberts was a known, pliable and reliable tool. He merely serves, and has always served, the elite establishment and has this week earned his thirty pieces of silver for services rendered.

I can’t say what motivates Roberts but for the presidents who nominate Supreme Court justices I’d say there’s really no sure-fire way to know how they’ll end up ruling down the road. Remeber that Ronald Reagan himself appointed Justices Sandra Day O’Conner and Anthony Kennedy.
