Supreme Decision: The Best Possible Result for 2012

Politically speaking there couldn’t have been a better Supreme Court decision. If Obamacare had been declared unconstitutional, the Democrats’ campaign in November would have been those horrible Republicans have politicized the Supreme Court and denied affordable healthcare to everyone. The focus would be on the court’s “unfairness.” The Democrats would have a plausible if unfair case (and in politics lack of fairness is a given). Advantage Democrats. Advantage because the last things they want to talk about are Obamacare and taxes. And that’s the second big plus from this decision. The focus – thanks to Justice Roberts – is going to be on the biggest tax increase in human history on everyone, not just the rich. And on the lies of Obama which dwarf those of Clinton. Obama promised no tax hikes on the middle class and then defended Obamacare before the Supreme Court as …. a tax.

As for the constitutionalists. Roberts’ argument makes sense to me. Yes the power to tax is the power to destroy, but it’s in the Constitution. So this decision doesn’t really change anything constitutionally. If you don’t like Obamacare, the remedy is to repeal it. Let the elections begin.

I know a lot of people around here detest Dick Morris and I understand why and would never argue with them or defend the toe-sucker, but I have to admit, when this debacle happened yesterday I was very interested in what he had to say about it and I have always liked Horowitz and now here they are, both in agreement. I think they are making a persuasive argument.

Whether by sly cleverness or RINO stupidity or lefist evil, Roberts has given us a gift.

It’s a POS ruling of historic inanity, but it is, nevertheless, a gift.

Every Repub, especially Romney and his campaign team, should be screaming, “Obama LIED TO US and DECEIVED US to get the biggest tax increase ever and to give us socialized healthcare because they knew they could get it no other way.”

BUT neither Romney nor the Repubs have the cajones to use these words though......

It’s no gift it’s a disaster. This article is wishful thinking. No candidate is going to win or lose based on whining that the Republicans have politicized the supreme court. It will be about the economy. Roberts kept us under govt’s boot, plain and simple.

I agree. It's a gift of the most backhanded nature, but it's there. The mandate having now been judically defined as a tax crystallizes the arguments against it. Most Americans don't understand the concept of "Commerce Clause," but "Tax"... that's something they'll understand. And this "tax" will apply to ALL.. not just the "evil" wealthy.

Damned right it's a gift... now, let's see how the GOP side plays it.

My very first thought, was the TV picture of Justice Roberts at the first, IIRC Obama state of the Union address, where the court and justice Roberts were taken to the woodshed by the excuse for a president. I think Justice Roberts is willing to heap scorn on himself, because of what his decision is going to do TOO mr obama come November.

It’s an effing disaster. Even if THIS is finally the group of R’s with enough stones to undo a Dem feat of socialism, and even IF they get elected, and even if they keep their word and repeal it, the precedent is now set that a program of this scope and intrusiveness is Constitutional and fully acceptable. Try and repeal THAT.

Had it been 5-4 against, there would have been charges of unfairness, illegitimacy, politicization, evil, corruption, naziism and the usual list of accusations by Progressives when things don’t go their way. (revolutionary scu&bags)

Yes the power to tax is the power to destroy, but it’s in the Constitution...

But which one?

Is it a direct tax? (Art 1 Sec 9, "No Capitation, or other direct, Tax shall be laid, unless in Proportion to the Census...")

Is it an excise tax? (Don't think so...)

Is it an income tax? (16th Amendment)

And if it's not a specific kind of tax, new precedent has now been set that congress need not care in the future either...

...and IMHO would have guaranteed the reelection of mr obama. Justice Roberts is a whole lot smarter than the occupier of the White House.

If this proves wrong, well, I’ll be the first to admit it.

This whole act reminds me of a Michael Connely novel where an attorney cannot go after his client for a past murder but instead allows others to convict him.

This may be a victory lap around the swimming pool for Obama but the award he is carrying is made of lead, it will sink Obama.

Horowitz is on LSD again. Tax bills must originate in the House, not in John Roberts chambers. Secondly no matter what else happens the precedent is now set that the fedguv can order you to do anything or not do anything and if you don’t comply you can be taxed. Finally there are now 5 liberals firmly entrenched on the SCOTUS who have no regard for limiting federal power.

There is no silver lining. None, nada, zilch.
