The Administration is following the US Supreme Court on this one ... as the court said that was within their ability.
Arizona can do what the court said it was allowed to do and the Federal Government can do what the court said it was allowed to do.
This decision by the court really didn’t settle the “Immigration Issue”. That’s going to have to happen within the political sphere. It’s going to require a President who will “make policy” which engages in “mass deportations” ... then you’ll get something done.
If the SC said AZ cannot enforce federal law, why can’t AZ refuse to enforce ALL federal laws?
Yup. The SCOTUS has ruled that AZ LEO can ask people for proof that they're not illegal and can call the feds to pick up the illegals, and has ruled that the feds can tell AZ to pound sand.
Judge Andrew Napolitano gave his analysis on Fox. The judge stated that the heart and soul of the Arizona law was struck down. Only feds may enforce immigration laws.
On the status ruling it is unclear. Difference in a police officer checking to see if they are wanted vs see if they are illegal
If an officer stops someone for a DUI or jaywalking...the right to check status will probably end up in courts. Sad day for America.
