I would hope that it is, because then it would qualify as an attempted manipulation of Justice Kennedy & CJ Roberts. However, my husband was watching Jake Tapper on Imus this morning (6/25). Didn’t see it, so I don’t know if it was live, but it’s still a current prediction. And today’s ruling did nothing to diminish the analysis.
Tapper would not like to seem as if he is changing his mind so it is reasonable for him to stick with his original prediction. In any case it is a pure guess and as such is worth what anyone else’s guess is worth
Ginsberg and Roberts have not written an opinion since May 21. That means they are probably the authors of the Majority opinion and the Dissenting opinion. If that is the case they are probably on different sides of the issue.
I would suspect that makes Mr. Tapper’s claim improbable.
