Sounds to me like a simple ploy to try and insure that a trial is held. The prosecutors know they will lose, and they want to make sure that a civil case will go forward.

Does the judge get to see this evidence at the pretrial hearing when Z has a chance to get the case dismissed, or does the prosecution merely have to state that they have compelling evidence that won’t be released until the trail?
