Condition of release. The judge doesn’t have to let him out at all, and AFAIK may place any restrictions on that release as seen fit. On any whim whatsoever the judge can call for his return to prison. He may be walking around, but he could just as easily be where he has absolutely no rights whatsoever; he still has no rights but those the judge deigns to allow, in this case free to move about but disarmed.
