I thought there was an initial grand jury and they didn’t issue a true bill for first degree murder, hence the prosecutor charging him with 2nd degree, which doesn’t require a grand jury to indict.

I believe a states attorney initially declined to proceed, based on the evidence, and it was never presented to a grand jury. The state, under pressure, reopened the investigation which resulted in the 2nd degree charge.
