Mifflin asserted that a United States president had no authority to order a state governor to use state militia for any purpose during peacetime and in the absence of any local request for assistance. Mifflin's point was established, setting a precedent that is still honored. Lincoln didn't order the State Militia, he asked for volunteers.
Maybe you need to follow the context of the precedent a little more closely.

precedent
1) n. a prior reported opinion of an appeals court which establishes the legal rule (authority) in the future on the same legal question decided in the prior judgment.
