Actually it doesn't. As Alan Dershowitz pointed out, it doesn't even come close to establishing probable cause for 2nd degree murder. The affidavit contains NO evidence regarding the stringent culpablilty elements of a 2nd degree murder charge. He shouldn't even have to put up a bail.
This prosecutor has used this affidavit as an application to the Mike Nifong legal firm.
Dershowitz called her irresponsible and unethical. She has left out major parts of the evidence. If Zimmerman has a good lawyer this prosecutor will have to fight to keep her law license.
The Fifth Amendment states that "No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury..."
Surely being accused of murder and facing a possible penalty of life imprisonment makes this an "infamous" crime. (At least that's my opinion...but I'm not a lawyer.)
