Is a "felony" a felony if the government has no legit power to make that law in the first place?
It stems back to this... What is a crime? Is it simply breaking the law? Or does a real crime have a perpetrator, a victim, and actual damage done?
The founding Fathers of this Country advocated the latter. Or as Thomas Jefferson put it...

What would have been the outcome had he not been accused of the steroid allegations? Some muscle-headed firefighter putting out fires? Ooohhh... the horror! Maybe they should have just dropped a JDAM on his house from the outset...
The guy was a roid head with a small pee pee complex who liked to beat on women. Because he was a vaunted firefighter he thought and did get away with things that average citizens would not.
