They can claim whatever they want. However, NEPA doesn’t grant the federal leviathan the power to violate the Constitution.
The EPA, oddly enough, was not created by a law. It was created by Richard Milhouse Nixon and his “Reorganization Plan No.3” Executive Order. To my knowledge, it’s the only federal agency in the bureaucracy that was not created by Congress.

They can claim whatever they want. However, NEPA doesn’t grant the federal leviathan the power to violate the Constitution.I'm not a lawyer, but after a glance at it I decided it was unconstitutionally vague, at least as DHS is trying to claim. I didn't look beyond that.
